These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.thebalancedmedspa.com/ (the "Site") and the services, treatments, and communications provided by Balanced Aesthetics & Wellness, located at 2118 El Camino Real, Suite 13, Santa Clara, CA 95050 ("Balanced Aesthetics & Wellness," "we," "us," or "our"). By accessing the Site, scheduling an appointment, or otherwise using our services, you ("you," "your," or "Client") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

1. Services

Balanced Aesthetics & Wellness provides wellness and aesthetics services, which may include but are not limited to skin treatments, injectables, body contouring, wellness therapies, and related consultations (collectively, the "Services"). Descriptions of Services on the Site are for informational purposes only and do not constitute a guarantee of results. Availability of specific Services may vary by location and provider.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to schedule or receive Services, or to use the Site, unless accompanied by the consent of a parent or legal guardian where permitted. By using the Site or our Services, you represent that you meet this requirement and that all information you provide to us is accurate and complete.

3. Appointments, Cancellations, and No-Shows

Appointments may be scheduled through the Site, by phone, by text message, or by email, subject to availability. By booking an appointment with Balanced Aesthetics & Wellness, you acknowledge that your appointment time is reserved exclusively for you and removed from availability for other patients.

A minimum of 4 days' notice is required to cancel or reschedule an appointment.

Cancellations or rescheduling requests made within 4 days of the scheduled appointment, as well as no-shows, result in forfeiture of the $200 deposit and an additional $100 charge to the card on file, for a total non-refundable amount of $300.

Appointments may be rescheduled one time only when proper notice is provided. No-show appointments are not eligible for rescheduling.

Any outstanding cancellation, rescheduling, or no-show fees must be paid in full before a future appointment may be booked.

Appointment reminders may be sent as a courtesy; however, it remains the patient's responsibility to attend scheduled appointments and provide adequate notice of any cancellation or rescheduling request.

We reserve the right to reschedule or cancel appointments due to provider availability, illness, equipment issues, or other circumstances beyond our control, and will make reasonable efforts to notify you promptly.

4. Payment Terms

Prices for Services are as quoted at the time of booking or as posted on the Site and are subject to change without notice for future appointments. Payment is due at the time Services are rendered unless otherwise agreed in writing. We accept the payment methods indicated at checkout or in person. Package purchases, memberships, and gift cards are subject to any additional terms disclosed at the time of purchase, including any expiration or non-refundable provisions.

5. Medical and Wellness Disclaimer

Aesthetic and wellness treatments may carry risks, and individual results vary. Before receiving certain Services, you may be required to complete a health history form, consultation, and/or informed consent document. It is your responsibility to disclose all relevant medical history, allergies, medications, and conditions. Nothing on the Site or communicated by our staff is intended as medical advice, diagnosis, or treatment, and should not be relied upon as a substitute for consultation with a qualified healthcare provider. Balanced Aesthetics & Wellness makes no guarantee regarding the outcome of any Service.

6. Client Conduct

You agree to treat our staff, providers, and other clients with respect. We reserve the right to refuse Services, or to end an appointment in progress, in cases of abusive behavior, safety concerns, non-disclosure of relevant health information, or violation of these Terms.

7. Communications — Email, Text, and Phone

By providing your phone number and/or email address, you consent to receive communications from Balanced Aesthetics & Wellness related to appointment scheduling, confirmations, reminders, post-care instructions, billing, and — where you have separately opted in — promotional or marketing messages, via email, text message (SMS), and/or phone call. Message frequency will vary depending on your interactions with us. Standard message and data rates from your wireless carrier may apply. You may opt out of promotional communications at any time as described below or by using the unsubscribe/opt-out method provided in the applicable communication; certain transactional or account-related communications may still be sent as necessary for the provision of Services.

8. SMS Messaging Terms of Service

Balanced Aesthetics & Wellness SMS Program

This service provides appointment reminders, treatment confirmations, post-care instructions, and promotional offers for aesthetic treatments to patients who have opted in to receive text messages from Balanced Aesthetics & Wellness. You can cancel the SMS service at any time. Just text "STOP" to +1 (408) 403-0787.

After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at info@thebalancedmedspa.com or +1 (408) 403-0787. Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive approximately 3–5 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. If you have any questions regarding privacy, please read our Privacy Policy.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Balanced Aesthetics & Wellness or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

10. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by Balanced Aesthetics & Wellness. We are not responsible for the content, privacy policies, or practices of any third-party sites.

11. Limitation of Liability

To the fullest extent permitted by law, Balanced Aesthetics & Wellness, its owners, employees, and providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services, including but not limited to treatment outcomes, missed communications, or service interruptions. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the Service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Balanced Aesthetics & Wellness and its owners, employees, and providers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site or Services, or your violation of any applicable law or third-party right.

Our collection and use of your personal information is described in our Privacy Policy. By using the Site or our Services, you consent to the practices described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised "Last Updated" date and will be effective as soon as it is posted. Your continued use of the Site or Services after any changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
